High hedges are a common cause for dispute and are covered under the Anti-Social Behaviour Act 2003.

Under this act there is published guidance and a series of calculations relating to light loss to the windows of main living rooms and to the garden. The resulting figure is called the 'action hedge height'. This is the height at which the hedge must be legally maintained.

If the hedge requires cutting to a lower height; an independent consultant's report on their findings may then be used between you and your neighbour to resolve any problem. We find that this can avoid lengthy and costly legal disputes. It is in the hedge owner's best interest to comply with any recommendations made, as the next stage of unresolved disputes can involve prosecution by the LPA.
